Terms & Conditions

The legal agreements governing our consulting and engineering services.

These Terms and Conditions ("Terms") govern your use of the website (ecoserveindia.com) and the environmental consulting, compliance, and engineering services provided by Eco Serve India Pvt. Ltd. ("we," "us," or "our").

By accessing our website, requesting a consultation, or engaging our services, you ("Client," "you") agree to be bound by these Terms. If you do not agree with any part of these Terms, you must refrain from using our services.

1. Services Provided

Eco Serve India provides specialized environmental engineering and consulting services, including but not limited to:

  • Liaising for Consent to Establish (CTE) and Consent to Operate (CTO) from State Pollution Control Boards (e.g., MPCB) and Central Pollution Control Board (CPCB).
  • Design, installation, and optimization of Effluent Treatment Plants (ETP) and Sewage Treatment Plants (STP).
  • Environmental auditing and compliance reporting for CGWA and DISH regulatory bodies.

The specific scope of work, deliverables, and timelines will be detailed in a separate, mutually agreed-upon Service Agreement or Purchase Order prior to the commencement of any project.

2. Client Responsibilities

To ensure timely and successful execution of our services, you agree to:

  • Provide accurate, complete, and up-to-date data regarding your facility's operations, manufacturing processes, and existing environmental clearances.
  • Ensure our field engineers and auditors have safe and unhindered access to your premises for inspections and sample collection, as required.
  • Promptly respond to requests for documentation or clarifications needed for government submissions. Delay in providing information may result in corresponding delays in regulatory approvals, for which Eco Serve India shall not be held liable.

3. Fees and Payment Terms

Our consulting fees and engineering costs will be outlined in our official commercial proposal. General payment terms are as follows:

  • Consulting Fees: Payments are typically structured in milestones (e.g., Advance, Upon Application Submission, Upon Grant of Consent).
  • Statutory Fees: Any official fees, challans, or penalties levied by regulatory bodies (e.g., MPCB consent fees) are to be paid directly by the Client or reimbursed to us at actuals. These statutory fees are strictly non-refundable once paid to the government.
  • Late Payments: Invoices must be settled within the timeframe specified in the commercial proposal. We reserve the right to pause ongoing work or withhold final regulatory documents until outstanding dues are cleared.

4. Limitation of Liability

While we leverage our technical expertise to secure your environmental clearances and ensure compliance:

  • Eco Serve India acts as a consultant and facilitator. The final granting of consents, clearances, or licenses is at the sole discretion of the respective government authorities (MPCB, CPCB, CGWA, etc.).
  • We cannot be held liable for delays, rejections, or penalties resulting from changes in government regulations, bureaucratic delays, or the Client's failure to provide accurate data or adhere to statutory norms.
  • In no event shall our total liability for any claim arising out of our services exceed the total consulting fee paid to us for that specific project phase.

5. Intellectual Property

All proprietary designs, engineering drawings, compliance methodologies, and audit frameworks developed by Eco Serve India remain our exclusive intellectual property until full payment is received. Upon final payment, the Client receives a non-exclusive license to use the customized designs and reports solely for the operation and compliance of the specific facility they were created for.

6. Termination

Either party may terminate the engagement with a written notice of 30 days. Upon termination, the Client shall pay for all services rendered and out-of-pocket expenses incurred up to the date of termination. Any advance payments covering unexecuted work will be refunded after deducting applicable administrative and processing charges.

7. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Pune, Maharashtra.
