1. Introduction & Acceptance

Welcome to Eco Serve India Pvt. Ltd. By accessing our website, engaging our consultancy services, or contracting us for engineering/fabrication work (STP, ETP, ZLD), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not utilize our services.

These Terms apply to all clients, visitors, users, and others who access or use the Service.

2. Scope of Environmental Services

Eco Serve India provides specialized environmental engineering and legal liaisoning services, including but not limited to:

• Maharashtra Pollution Control Board (MPCB) Consent management (CTE/CTO).
• Central Pollution Control Board (CPCB) Extended Producer Responsibility (EPR) registration.
• Design, manufacturing, erection, and commissioning of Pollution Control Systems.
• Directorate of Industrial Safety and Health (DISH) compliance and audits.
• Central Ground Water Authority (CGWA) NOC abstraction approvals.

We reserve the right to refuse service to any entity whose operations fundamentally contradict environmental sustainability or involve illegal practices.

3. Client Responsibilities & Data Accuracy

The success of our liaisoning and engineering work relies heavily on the accurate provision of data. The Client agrees to:

• Provide accurate, complete, and truthful operational data regarding production capacity, raw materials, and effluent generation.
• Grant our engineers and auditors safe and unimpeded access to the industrial facility for inspections, sampling, and system installation.
• Notify us immediately of any changes in production processes that may alter effluent characteristics or regulatory obligations.

Eco Serve India shall not be held liable for rejected consents, fines, or system failures resulting from inaccurate, withheld, or falsified data provided by the Client.

4. Turnkey Engineering & Equipment (STP/ETP/ZLD)

For contracts involving the physical installation of treatment plants:

Design Variations: Engineering designs are based on lab-scale treatability studies. Minor variations in actual site execution may occur and will be communicated.

Warranties: Mechanical and electrical equipment supplied by Eco Serve India carry a standard manufacturer's warranty (typically 12 months from commissioning), provided the plant is operated within the designed parameters. Biological failures due to toxic shock loads introduced by the client void all process warranties.

Maintenance: Unless an Annual Maintenance Contract (AMC) is actively in place, the daily operation and chemical dosing of the plant is the sole responsibility of the Client.

5. Intellectual Property Rights

All methodologies, Treatability Study Reports, P&ID layouts, AutoCAD drawings, and proprietary engineering designs generated by Eco Serve India remain our exclusive intellectual property.

Clients are granted a non-exclusive, non-transferable license to use these documents strictly for their internal compliance and operational purposes. Unauthorized sharing, reproduction, or distribution of our designs to third-party vendors or competitors is strictly prohibited and subject to legal action.

6. Limitation of Liability

While we execute all liaisoning and engineering duties with the utmost professional diligence, regulatory authorities (MPCB, CPCB, CGWA, DISH) reserve the ultimate discretionary right to grant, delay, or reject approvals based on their independent assessments.

Therefore, Eco Serve India shall not be liable for:

• Consequential, incidental, or indirect damages, including lost profits or halted production, resulting from regulatory delays.
• Penalties or Environmental Compensation (EC) levied upon the client prior to our engagement or due to the client's failure to maintain continuous operational compliance.

Our maximum total liability, under any circumstance, shall not exceed the total consultancy or engineering fee paid to Eco Serve India for the specific project in question.

7. Confidentiality

We respect the sensitive nature of industrial operations. Eco Serve India agrees to hold all proprietary manufacturing data, trade secrets, and financial information disclosed by the Client in strict confidence. Such information will only be shared with regulatory authorities to the extent necessary to secure legal compliances.

8. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
