The Rajasthan State Pollution Control Board (RSPCB) is a corporate body formed under section 4 of the Water (Prevention and Control (P & C) of Pollution) Act, 1974. The board was constituted on 7th February 1975. RSPCB is entrusted with preventing and controlling water and air pollution. The board is also responsible for restoring or maintaining of wholesomeness of water and air. Any commercial activity is obliged to obtain Rajasthan SPCB NOC before initiating the process.

Rajasthan State Pollution Control Board (RSPCB) - Overview

The Rajasthan State Pollution Control Board (RSPCB) was initially formed under section 4 of the Water (Prevention and Control of Pollution) Act, 1974. Later, the board was also entrusted with the responsibilities of control, prevention and reduction of Air Pollution under the norms of the Air (P & C of Pollution) Act, 1981. The board is also liable to issue RSPCB consent certificates to commercial activities in the state.

Subsequently, the Water (P & C of Pollution) Cess Act, 1977, was enacted to make the board financially independent. Under this Act, Rajasthan SPCB has been given powers to collect Cess depending on the water consumed by the industries.

Enactment of the Environment (Protection) Act (EPA), 1986, has further widened the scope of the board's activities. This Act is an umbrella legislation; different rules for addressing the problems of several sectors have been enacted under this. RSPCB is involved in implementing specific regulations under the EPA, 1986.

Procedure for applying for RSPCB consent certificate

RSPCB accepts applications for CTE/CTO via an online system only, and there is no need for hard copies of any document.

The completed application must be submitted either to GM, DIC or Member Secretary, UPPCB Lucknow or to ROs of the board. To ease the process of obtaining CTE from UPPCB, the board has decentralised this certificate's issuance power. The powers have been delegated to GM, DIC and Regional Officer (RO), UPPCB.

For New Users

1. Registration for new users is done either via:

a. Rajasthan Single Sign-On facility available at www.sso.rajasthan.gov.in or

b. Apply online facility available at the State Board’s website http://environment.rajasthan.gov.in/content/environment/en/rajasthan-state-pollution-control-board/Applyonline.html

2. Applicant receives a Login Id and Password on the e-mail id and mobile number provided during registration.

3. Use the above-received Login Id for filling out the application.

4. Before starting online filling, please refer to the guidelines/manual on the website.

5. Keep scanned copies of essential documents in PDF format ready so that the same can be uploaded easily.

6. after that, log in and start filling out the application. Fields marked with an asterisk (*) can't be left empty.

7. Using the Payment Options tab, generate a challan number against which the RSPCB consent certificate fee must be paid.

8. Payment can be made by electronic transfer modes such as RTGS/NEFT/Net/Online Banking. Payment can be made through debit cards or cash at e-Mitra kiosks.

9. After fee payment, upload the essential documents.

10. Check all the details and proceed with submission.

For Existing Users:

1. Check the recent guidelines on the board's website.

2. Follow all the steps from point no. 3 to 10 for applying.

Process:

1. The appropriate authority scrutinises the application and/or documents for obtaining the RSPCB consent certificate.

2. Incomplete info (if any) is notified to the applicant online, which can be tracked via login ID.

3. The analysis and inspection reports can also be tracked via login ID.

4. Actions taken on the application (notices issued, deficiencies observed) are also tracked via login ID.

5. The final decision taken on the application is notified to the applicant. The decision can be tracked via login ID.

6. Further, a digitally signed copy (with QR Code) of RSPCB NOC is mailed to the applicant.

7. Applicants can also download the consent letter from the board's website via login ID.

8. For online submission of applications, users can also avail of the facility of the e-Mitra kiosk networks available all over Rajasthan.

RSPCB Consent Certificate Fees

1. When an applicant applies for obtaining consent to operate from RSPCB after the expiry of earlier consent, the application for CTO must be accompanied by an extra fee of 50% as mentioned in the Schedule.

2. Any activity/industry/operation/process that is non-polluting and categorised as White Category in Part IV of the Schedule must not be needed to obtain RSPCB CTE and CTO but must have to intimate the board before commissioning activity/industry/operation/process.

3. The RSPCB grants CTO for 5, 10 and 15 years in the case of the Red, Orange Green categories, respectively. This category must be according to the categorisation decided by the state board gradually.

4. The prescribed fee must be paid to the Member Secretary, Rajasthan State Pollution Control Board, in a way mentioned by the RSPCB gradually.

Frequently Asked Questions

  • 1. What is the auto-renewal process of the RSCP consent (CTE/CTO) certificate?

    • The renewal application is made 120 days before the expiry of consent.
    • There is no modernisation/expansion/change in process/ raw material/product/fuel or pollution load.
    • There are no pending prohibitory directions from Appellate Authority/Courts/National Green Tribunal/other Judicial Authority.
    • All requisite compliance reports of earlier consent and supporting documents have been submitted.
    • Environmental statement reports, as prescribed under the rules, have been submitted.
    • In the last inspection, the process/industry/activity is found compliant with earlier consent conditions, and the analysis report indicates all parameters within allowed limits.
    • There are no directions under 33(A) of the Water (P & C of Pollution) Act, 1974 and 31 (A) of the Air (P & C of Pollution) Act, 1981 and section 5 of the EP Act during the last five years.

    The proponent must apply with the following documents for auto-renewal of the consent:

    • 1. Prescribed fee
    • 2. Project Report (Financial part, in case of RSPCB CTE)/capital investment certificate in the project as on the date of application/end of the financial year, in the specified format, certified by the CA (in case of Consent to Operate).
    • 3. Affidavit cum Self Certification with the declaration in the prescribed format enclosed as Annexure - B.

    Applicant must apply for RSPCB CTO/Consent to Establish online, which will be verified for adequacy of fees, as may be applicable and submission of documents as prescribed above and will be renewed online by the concerned Regional Officers/Group Head within ten working days. The documents of the consent letter will be sent online which can be downloaded. In the case of non-fulfilling auto-renewal requirements, the project proponent must be informed accordingly, and the consent application must be processed in the normal course.
