Industries that fall under categories, i.e. Red, Green, Orange (and a newly introduced white category) listed by the Central Pollution Control Board (CPCB) must approach Punjab Pollution Control Board for these PPCB consent certificates. The State Board, via its SPCB NOC, guarantees that any manufacturing plant or unit is constructed according to the location policy of the individual State. It also ensures any risky industry doesn't get permission to establish or operate in a prohibited or sensitive zone or area of the State.

Punjab Pollution Control Board (PPCB) - Overview

The Punjab Pollution Control Board (PPCB) was formed in 1975 after the enactment of the Water (Prevention & Control (P&C) of Pollution) Act, 1974. The Board was responsible for issuing PPCB consent certificates to the industries in the State. Another aim was to preserve the water quality. Subsequently, with the implementation of other environmental laws, the responsibility to implement the norms of such laws was also endowed to the PPCB.

To have uniform laws all over India for broad environmental issues endangering the health and safety of our people and flora and fauna and also to prevent environmental degradation, the Government of India (GoI) introduced the following laws:


  • The Water (P&C of Pollution) Cess Act, 1977
  • The Water (P&C of Pollution) Act, 1974, as amended to date
  • The Air (P&C of Pollution) Act, 1981, as amended to date

The policy of the Board regarding PPCB Consent Management

  • After enacting the Water (P&C of Pollution) Act, 1974 and the Air (P&C of Pollution) Act, 1981, the State Board gradually framed guidelines/policies for PPCB consent management according to the prevailing situations.
  • Also, the Board has framed a comprehensive policy for consent management to streamline the process for granting various statutory clearances viz-a-viz hassle-free PPCB consent clearance to the entrepreneurs to encourage industrial growth in the State.
  • To witness sustainable industrial growth in Punjab, it was observed to review the policy/guidelines of the State. Furthermore, the State is in the process of implementing administrative reforms to achieve sustainable development. Thus, Consent Management Models (CMM) of various SPCBs, such as Tamil Nadu, Gujarat PCB, and Haryana PCB, were studied in detail.
  • The revised consent management/policy for the grant of various statutory clearances, such as the PPCB consent certificate under the Pollution Control Laws, EPA, 1986 and rules framed thereunder, is given below:

A. Industries categorisation

PPCB has categorised all existing and new industries into three categories, namely Red, Green and Orange, considering their pollution potential.

But, if any extra industry category is left out of the above scheme, a Committee comprising of a Senior Scientific Officer, Senior Environmental Engineer (HQ-2) and Environmental Engineer (HO) will decide the industry category according to its pollution potential.

B. Consent to Establish (PPCB CTE)

  • No industrial activity, plant, operation, process, any construction project, including Industrial Township, New Township, Settlement Colonies, Hotel Complexes, Commercial Complexes, Hospitals and Office Complexes, Industrial Area/Industrial Estates can be established, or expansion of any existing project/industry must be done in Punjab except the industries exempted from PPCB consent management, without obtaining 'CTE' under the Water (P&C of Pollution) Act, 1974 and Air (P&C of Pollution) Act, 1981.
  • All the prospective entrepreneurs who wish to establish such projects as above must obtain PPCB CTE. The PPCB has created a common application form for medium, large and small-scale industries for consent management will be issued individually and is available on the website of the State Board, i.e. www.ppcb.gov.in.
  • The application to be submitted by the entrepreneur for PPCB consent to establish must be accompanied by requisite documents.
  • The Board accepts the application for PPCB consent management of all large, medium and small-scale industries for obtaining Punjab PCB NOC via 'Online Consent Management and Monitoring System (OCMMS).' However, small-scale industries can submit hard copy also.
  • Since the State Board is trying to become entirely paperless, it does not encourage industries to submit offline PPCB consent NOC applications. However, to maintain the records, the Board accepts one hard copy of the application and the documents duly signed by the authorised signatory.
  • PPCB has implemented a payment gateway system for all charges payable to it from 1st April 2013.
  • The Board decides on the applications for PPCB Consent to Establish (NOC) of all industries to be established in approved/designated areas like Industrial Areas/Estates/Focal Points and approved Industrial Zone/Parks of the Master Plan. However, the site clearance u/s 41 (A) of the Factories Act, 1948, is unnecessary to grant PPCB consent to operate/establish.
  • A copy of the State Pollution Control Board NOC granted to the entrepreneur is endorsed to the Dept. of Factories, Punjab. Also, a condition is imposed in the PPCB CTE to the effect that the industry/entrepreneur must obtain necessary statutory clearances/permissions from all other concerned departments.
  • For industries to be established in areas other than the sites like approved/designated areas like Industrial Area/Focal Point/Estate/approved Industrial Park/Zone of the Master Plan, site clearance u/s 41 of the Factories Act, 1948 is mandated before the grant of PPCB CTE.
  • In cases where an industrial plot is allotted by any of the agencies of the Government/ statutory bodies or by a project developer whose project industrial park is approved by the State Government, a certificate of allotment/sale of a plot by such an agency is considered for grant of Punjab SPCB NOC (CTE).
  • The Board continues to grant PPCC consent to establish any category of industries that are allowed in the mixed land use zones/areas according to the by-laws of the notified/draft Master Plan. The Board officers must check the permissibility of establishing such industry in the mixed land use from the by-laws of the Master Plan.
  • In cases where the site of the project is situated in an area other than zones like approved/designated areas like Industrial Area/Focal Point/Estate or approved Industrial Park/Zone of the Master Plan, a certificate of its site/location from the nearest village lal lakir/phirni/MC limits from the Revenue Authorities like Deputy Commissioner/Additional Deputy Commissioner or the Sub-Divisional Magistrate is mandatory for grant of PPCB CTE NOC.
  • PPCB grants consent certificates to new industries of all categories, which are intended to be sited in the designated Industrial areas/zones of the draft/notified Master Plan based on undertaking submitted by the entrepreneur to the effect that the proposed site of the industry/project is located in the specified Industrial area/zone of the notified or draft Master Plan in which the establishment of such project/industry is permissible. The undertaking to be submitted by the entrepreneur must indicate the revenue entries, i.e. khatauni number/Hadbast Number, khewat and Khasra numbers. A copy of the PPCB consent certificate along with the undertaking and location plan of the industry clearly stating the category of industry (red/green/orange) will be sent by the concerned Environmental Engineer/Senior Environmental Engineer to the specific Local Body/District Town Planner of the Department of Town & Country Planning, Punjab/ Development Authority.
  • Also, an intimation regarding this will be sent via e-mail with the request to inform the applicant (project proponent) under intimation to the PPCB within 15 days if the authority has any objection to the proposed site at the proposed location.
  • It will be stated in the endorsement that if no reply is received from the authority above within 15 days, then it will be presumed that the suggested site is ideal for the project from the point of view of the above referred Competent Authority.
  • However, in case of any objection to the project site by the above-referred Competent Authority or any of the documents or undertakings are found wrong, the PPCB consent certificates granted to the project will be deemed cancelled. The Board will not be responsible for the cost incurred by the project proponent based on the SPCB NOC. In addition, a condition will be levied to the effect that in case any amendment/change in the draft Master Plan is needed, then the project continuance will be subject to such amendments/changes in the draft Master Plan by the Competent Authority.
  • According to MoEF&CC (the Ministry of Environment, Forests and Climate Change), there is no link between PPCB CTE of the new projects/industries/activities to be granted by the Board under the Acts with the environmental clearance (EC) under EIA Notification.
  • The feasibility report to be submitted along with the application for the PPCB consent certificate must be prepared by a consultant having acquired at least Bachelor's Degree/AMIE in Chemical/Environmental/Civil Engineering from a recognised University/Institution or the institution having degree courses in Chemical/Environment/Civil Engineering field. Apart from the above, Charted Engineers to be approved by the Board must also be competent to prepare a feasibility report. Such Charted Engineer/consultant/Institution will append an undertaking to such an effect with the feasibility report concerning the abovementioned qualification.

C.Revalidation of PPCB Consent to Establish (CTE) (NOC)

  • Every entrepreneur must complete the construction of an industrial project/unit and the installation of pollution control equipment within the validity of the PPCB NOC.
  • But if the project/industry promoter fails to implement the project within the validity of the PPCB consent certificate, then the project/industry promoter must get the NOC revalidated.
  • For this purpose, the industry must submit the progress made in installing pollution control devices viz-a-viz main project to the concerned Regional Office (RO) of the PPCB.
  • Such a request must be given only if the industry's progress in installing pollution control devices is equal to the main project, both physically and financially. For extension in the PPCB consent certificate validity of NOC for a further period of one year/part of the year, the project/industry promoter must pay 50% of the normal fee applicable for one year. The fee is charged annually, and for a part of the year, the PPCB consent fee is charged for an entire year. For extension in the validity of SPCB NOC, the project/industry promoter must apply on the prescribed proforma.
  • In any case, the validity of PPCB's 'consent to establish' (NOC) can't be extended for more than five years from the issuance date. Suppose any project/industry promoter applies for an extension of the PPCB NOC validity for more than 5 years. In that case, such project/industry promoter must apply afresh for a PPCB consent certificate from a pollution angle and the same will be processed/dealt with/decided according to the guidelines/policies prevailing at that time.

D. PPCB Consent to operate new projects/units/activities

  • Before putting into operation any project/industrial plant/activity, the entrepreneur must obtain PPCB CTO u/s 25 of the Water (P&C of Pollution) Act, 1974, & to operate an industrial plant u/s 21 of the Air (P&C of Pollution) Act, 1981.
  • The Punjab Pollution Control Board has proposed a composite proforma for obtaining PPCB consent to operate for all categories of projects/industries, which is available on the website of the Board, i.e.www.ppcb.gov.in.
  • The entrepreneurs must submit a Composite Application Form for obtaining PPCB CTO NOC u/s 25/26 of the Water Act, 1974 and u/s 21 of the Air Act, 1981 and a Hazardous Waste Management authorisation .
  • On the said application, individual PPCB consent certificates will be issued by the Competent Authority. The application to be submitted by the entrepreneur for PPCB consent to operate must be accompanied by the requisite documents.
  • If any existing project/industry promoter modernises its industrial plant, expands its industrial activities, or makes any technological changes in the manufacturing process, increasing the water/air pollution load, the project/industry promoter must obtain varied PPCB consents under the norms of various Acts.
  • The entrepreneur must apply for PPCB CTO renewal after the same expiry.
  • The Board grants PPCB consent to operate all the projects/industries/establishments in the zones/areas where such project/industry/establishment is permitted to establish.
  • The project industries/proponents must submit a building plan prepared and duly authenticated by the Chartered Architect/Director of Factories/Chartered Engineer as may be authorised under the norms of section 3-A of the Punjab Factory Rules, 1952.
  • The Board implements an e-governance system for PPCB consent management, and the applicant must submit all needed info online. He can download the PPCB consent certificates soon after the approval of the competent authority.
  • For the facilitation of industries, the Board accepts analysis results of NABL-accredited private labs for the grant of PPCB consent.

E.Clearance Certificates

PPCB Consent Certificate to be granted by the Board won't be a pre-requisite for the release of electric connection to the industries by the Punjab State Power Corporation Ltd.

F. Siting criteria

  • No new industry of any category is allowed in the approved residential area of any city/town of Punjab.
  • Also, no orange/red category of the industry is given PPCB consent to establish within MC limits except in the designated industrial zone/area.
  • The Board continues to grant PPCB CTE to any industry category permissible in the mixed land use zones/areas as per by-laws of the notified/draft Master Plan.
  • All Orange/Red/Green categories of industries, which are to be established in the Zone/areas other than approved/designated areas like Industrial Area/Estate/Focal Point/Approved Industrial Park/Industrial Zone of the statutory/non-statutory Master Plans, are allowed to establish at a distance of 100m outside the Municipal Council limits/designated residential area/phirni of village/residential area comprising of 15 pucca houses by the Competent Authority of Punjab.
  • In such cases, a certificate of its site/location from the nearest village lal lakir/phirni/ MC limits from the Revenue Authorities like the Additional Deputy Commissioner/Deputy Commissioner or the Sub-Divisional Magistrate is required to grant PPCB NOC.
  • The siting norms introduced for establishing parboiling plants/rice shelling units, brick kilns/cement plants, hot mix plants and stone crushers, as may be amended gradually, will remain operative.
  • The siting norms issued by the Department of Forests and Wildlife Preservation related to the distance of the industrial projects/units from wildlife sanctuaries/zoos will remain operative.
  • The guidelines for establishing construction projects (residential colonies and commercial establishments such as theaters, shopping malls, etc.) will remain operative.
  • All the distances must be measured from the nearest source of air pollution up to the boundary of the establishments/project and, in the case of 15 pucca houses, up to the nearest house towards the source of air pollution.

G. PPCB Consent to Operate to the existing industries

  • The State Board continues to grant PPCB consent to operate to all industries not having any hazardous procedure, existing and operating in non-designated industrial areas before the date of notification of the Master Plan, provided the industry complies with the stated norms for the discharge of emissions/effluent.
  • The project industries/proponents must submit a building plan duly authenticated and prepared by the Chartered Architect/Director of Factories/Chartered Engineer as may be authorised to do so under the norms of section 3-A of the Punjab Factory Rules, 1952.
  • e-governance system for PPCB consent management is implemented by the Board. All necessary info must be submitted by the applicant online, and one must download the PPCB consent certificate soon after the approval of the competent authority.
  • For the facilitation of industries, the PPCB accepts analysis results of NABL-accredited private labs for granting consent.

PPCB Consent Fee

  • PPCB Consent to operate/establish fees from medium/large/small scale Orange/Red/Green industry categories is charged as mentioned by the Board.
  • The PPCB consent fee for the period 22nd October 2009 up to the period for which the consent is to be granted must be charged as stated.
  • The PPCB consent fee for 1st April 1992 to 9th October 1994 is calculated per fee criteria.
  • The PPCB consent fee for the period 10th October 1994 to 30th September 2004 is calculated as per fee criteria.
  • PPCB consent fee for the period 1st October 2004 to 21st October 2009 is calculated as per fee criteria.

Validity of PPCB consent to establish/operate

(i) PPCB Consent to establish

PPCB CTE's validity under the said Acts' norms is for one year.

(ii) PPCB Consent to Operate

All the industries are granted PPCB CTO for five years except for industries falling in the green category, where the consent is for ten years. However, the culminating period of CTO is as under:

  • After obtaining the PPCB consent certificates, the industry must inform the concerned RO of the Board that its APCD/ETP has stabilised and must request the said Office within three months to conduct a sampling of pollution control devices/performance study.
  • If the industry does not inform the Board, then it is the responsibility of the RO to visit the industry for monitoring after three months but not later than six months. Suppose the industry is found violating the norms of PPCB consent. In that case, it is liable for action under the norms of the environmental laws, including cancellation/revocation of consent granted to it.

The period prescribed for processing applications for PPCB CTO/CTE

The Govt. of Punjab has stated the following period for deciding the application for PPCB CTO/CTE under the said Acts under the Punjab Industrial Facilitation Act, 2005:

Note:

  • A separate consent fee is charged for obtaining PPCB CTO as needed under the said Acts.
  • The criteria/procedure for calculating fees and other modalities is applicable as defined in the policy of the Board.
  • For the grant of PPCB 'consent to operate' as needed under various Acts,  more than one year under any category, i.e. Orange/Red/Green, the consent fee is charged annually for a fraction of the year, and the consent fee is charged for a complete year.
  • For extension in the validity of PPCB 'consent to establish', only 50% of the normal fee applicable for a year is charged for the extension fee for one year or a fraction of the year.

    • (c) Certificate of Revenue Authorities (ADC/DC/SDM) siting the distance of the proposed site of the industry from the Phirni/MC Iimits/ Lallakir of the nearest village, in case the industry is to be established at a site other than the site in the industrial area /estate /zone of the draft master plan /industrial zone of the notified master plan. Or
    • (d) For industry-specific guidelines, documents/certificates as stated in the said guidelines (In case of Rice Sheller/Stone Crusher/Saila Plant/Brick Kiln/Hot Mix plant/Cement Grinding units etc.)

Certificate of Revenue Authorities (ADC/DC/SDM) indicating the distance of the proposed site of the industry from the Phirni/MC Iimits/ Lal lakir of the nearest village, in case the industry is to be established at a site other than the location in the industrial area /estate/zone of the draft master plan/industrial zone of the notified master plan.

Application for extension in validity of PPCB Consent to Establish (NOC) for Orange/Red/Green Category

1. Request letter giving the reason for non-completion of the project in the stipulated time along with the installation status of plant and machinery/pollution control devices. Note: 1. Application must be accompanied by 50% of NOC Fee per year as per total project cost

2. If the PPCB NOC was not granted online, one must submit a copy NOC granted, the Project Report, and a Feasibility Report submitted when obtaining the NOC.

1. If the PPCB NOC was not granted online, one must submit a copy NOC granted, the Project Report, and a Feasibility Report submitted when obtaining the NOC.

2. The application must be accompanied by a CTO fee according to the un-depreciated fixed assets of the industry as per the policy available on the website of the Board at www.ppcb.gov.in.
