Pollution Control Board, Assam (PCBA) - Overview

State Pollution Control Board, Assam (PCBA) is an autonomous statutory organisation formed on 2nd June 1975 under the norms of section 4 of the Water (Prevention & Control of Pollution (P&CP)) Act 1974. The Board has a view to protect the environment and prevent and control water and air pollution in Assam, occupying a prominent niche in India's progressive and industrial development. The Board is entrusted with powers to issue PCBA consent certificates to industries and commercial activities in the state.

PCBA Consent Management

Granting PCBA Consent Certificates under the norms of the Water (P&CP) Act, 1974 and the Air (P&CP) Act, 1981, is one of the essential functions of the Board.

A brief note on guidelines for obtaining the Assam SPCB NOC/Consent for the entrepreneurs is given below:

Water Act

Control of water pollution is achieved via administering conditions imposed in PCBA consent issued under norms of the Water (P&CP) Act, 1974. These norms regulate effluent quantity and quality, the discharge location and the frequency of monitoring of effluents. The surface and groundwater monitoring performed by the Board states that the water quality has enhanced over the years and is now reasonably good in general.

Air Act

Under the Air (P&CP) Act, 1981 PCBA consent certificate is mandatory for discharging emissions into the atmosphere. The Board issues NOC to air-polluting industries with conditions to regulate the quantity and quality of discharge and stipulate the frequency for monitoring the emissions.

PCBA Consent to Establish/Operate (CTE/O)

To set up an industry with potential for water/air pollution, prior PCBA consent under the Water/Air Act must be obtained respectively, which is granted in two phases:

Consent to Establish [CTE/NOC]

This PCBA consent must be obtained before establishing any process, industry, or plant.

Consent to Operate [Initial & Renewal] [CTO/RCTO]

Once the process/industry/plant is established along the required pollution control systems, the entrepreneur must obtain PCBA consent to operate the unit. The consent is given for a specific period, which must be renewed regularly.

PCBA Consent to Establish [PCBA NOC]

Before constructing/establishing a plant, the proposed industry must obtain PCBA CTE NOC under the Water and/or the Air Act. The application form fee is Rs. 500/-. Those who have obtained PCBA CTE need not submit applications again in the above forms. PCBA consent must be obtained before conducting any work at the site recommended for the project. The validity of PCBA CTE is five years. NOC must be renewed if the unit is commissioned after then. If renewal is not obtained within the validity period, a fresh application must be made to the Pollution Control Board, Assam.

Documents to be submitted with the PCBA CTE form

The documents that must be submitted along with the PCBA consent application form for application processing are:

  1. Project Report (Project report must also highlight the total project cost certified by CA/self-declaration or affidavit regarding project cost/duly countersigned by Financing Institution/Bank).
  2. Lease/Land Document with Jamabandi, affidavit concerning application submission regarding conversion of the land to commercial/industrial class (if any).
  3. Site Plan with area demarcated for plantation.
  4. NOC from Local body.
  5. Process Flow Chart with recommended potential
  6. Google map with co-ordinate at the centre covering a 1 km radius.
  7. Photograph of the site (maximum two nos) showing the complete area.
