Maharashtra Pollution Control Board (MPCB) was established in 1970. The Water (P&CP) Act, 1974 is a central legislation adopted in Maharashtra on 1st June 1981. Accordingly, MPCB was formed under the norms of section 4 of this Act. The Air (P&CP) Act 1981 was implemented in the state in 1983. Initially, some areas in Maharashtra were declared as Air Pollution Control Areas on 2nd May 1983. Subsequently, the entire state was declared an Air Pollution Control Area on 6th November 1996. Consequently, MPCB also functions as the State Board u/s 5 of the Air (P&CP) Act, 1981.

Essential Functions of the Maharashtra Pollution Control Board

  • To collect and disseminate details concerning pollution and the prevention, control or reduction thereof,
  • To plan a comprehensive program for the control, prevention, or reduction of pollution and secure executions thereof,
  • To inspect trade effluent and sewage treatment and disposal facilities and air pollution control systems,
  • To review specifications, plans, or any other info concerning the disposal systems, treatment plants and air pollution control systems related to the MPCB consent certificate granted,
  • Encouraging and supporting the developments in the fields of waste recycling and reuse, pollution control, eco-friendly practices, etc.,
  • To guide and educate the entrepreneurs in enhancing the environment by proposing appropriate pollution control techniques and technologies, and
  • Creation of public awareness about a healthy and clean environment and attending the public complaints regarding pollution.

MPCB CTE/CTO Under Water And Air Acts

Under the norms of the said Acts, an entrepreneur establishing or operating any process or industry and emitting pollutants/discharging effluent into any water resources or on air/land and polluting the environment is required to obtain MPCB consent, which is granted in two phases, namely -

  • Consent to Establish (CTE): CTE from MPCB must be obtained before establishing any process or industry.
  • Consent to Operate (CTO): the process or industry is established along the required pollution control systems, the entrepreneur must obtain CTO from MPCB. This consent is given for a specific time and needs to be renewed regularly.

MPCB Consent Certificate Fee

Fees for MPCB combined consent certificate for one term under the said Acts are as follows - The entrepreneurs must pay the consent fees to MPCB accordingly.

These fees, along with the completed prescribed form, are payable as a Demand Draft (DD) at any Nationalised bank at the respective Sub-Regional or Regional Office or headquarters. The term of the MPCB consent certificate for Red, Orange and Green category Industries is one, two and three years, respectively.

The industries can also obtain the SPCB NOC for an extended period of up to 5 terms by paying proportionate fees.

Process for new users to register on the MPCB portal and apply for Consent Certificates

Note - From 7th November 2017, Time Registration on the MAITRI portal has been mandatory before applying for any service under the Maharashtra Pollution Control Board, including the MPCB consent certificate. The steps for applying on the portal are as follows -

Step-1 : Click on any of MPCB's services, and a confirmation box pops up. Click 'Yes' to get redirected to the MAITRI portal for one-time registration.

Step-2 : A Single Window Portal appears. Fill in all the necessary details to register. After filling in all the relevant information, the applicant gets a User Login ID and OTP on his mobile phone. Login with the same and then click on "Register".

Step-3: Upon successful login, complete the Common Application form by clicking "CAF". This is a one-time process.

Step-4: After clicking on CAF, the user must fill in the desired fields. Upon entering the Aadhaar number in the CAF, the fields under the applicant's details are auto-filled from the Registration Page.

Step-5: After certifying, submit the required documents by uploading or fetching them from DG-Locker. Click on "Submit Documents".

Step-6: After submission of documents, make a nominal registration payment of Rs. 20 for applying for services on MAITRI.

Step-7: The user must fill in the requisite info for making required payments and click on “Pay Now” to make the payments.

Step-8: After making the payment, download the receipt.

Step-9: Subsequently, go to services provided to get the list of Services available on the MAITRI portal.

Step-10: All services under MPCB are listed under Department:

Step-11: On clicking on any of the Services, the applicant gets automatically redirected to the MPCB registration portal, where all the fields get auto-filled.

Step-12: Applicant must fill in the remaining fields, if any, and then complete the registration on the MPCB portal.

Note: In cases where all the mandatory fields are received from MAITRI, the applicant must not register. The system automatically registers him on the MPCB portal, and a notification e-mail and SMS are sent regarding login credentials of the MPCB portal. The applicant then can log in to his account automatically.

MPCB CTE PROCESS

  • 1. Applicant must register on the online website http://www.ecmpcb.in/. Applicants must not visit any of the MPCB offices throughout the application process. The online system allows one-time mobile verification for the applicant and one-time online document verification by the Department as a part of the process.
  • 2. Once registered, the applicant can apply online.
  • 3. Then the status is shown as "Document Pending". The status changes to "Payment Pending" after submitting the compulsory documents.
  • 4. Applicants must pay the fees online according to the fee structure.
  • 5. Applicant must update the payment details, and the status changes to "Payment Approved" on approval.
  • 6. SRO assigns the application to Field Officer. Once the officer reviews the application, he/she forwards the application through the Integrated Management Information System (IMIS).
  • 7. The application status changes to "In Process".
  • 8. Field officers scrutinise the application, visit the industry (for the establishment and first operation) and make his/her visit/recommendation report and submit it to Sub-Regional Officer.
  • 9. Now depending upon the Capital Investment and category of the industry, the application is forwarded through IMIS according to the delegation of power.
  • 10. The concerned authority now scrutinises the application; if it is fine, the application is granted in IMIS, and the status will be changed to "Approved" on the online portal.
  • 11. This is followed by uploading the signed consent copy. Otherwise, if the application is incomplete, it is rejected in IMIS and notifies the entrepreneur by marking the application status as "Rejected".
  • 12. Applicants can download the consent copy from the online portal.

Frequently Asked Questions

  • 1. How are industries classified into Red/Orange/Green/White Categories?

    The Ministry of Environment, Forest & Climate Change (MoEF&CC) introduced notifications in 1989. The notification introduced the concept of categorisation of industries as " Red", "Orange", and "Green" to facilitate decisions concerning their location. Subsequently, the implementation of this concept was extended in other parts of India not only for industries location but also for the Consent management and formulation of norms related to the inspection/surveillance of industries.

    To harmonise the "Criteria of categorisation", CPCB issued specific instructions u/s 18(1)(b) of the Water (P&CP) Act, 1974. All SPCBs/PCCs were instructed to maintain uniformity in industries categorisation as red, green and orange according to the list finalised by CPCB, which classified 85 types of industrial sectors as "Red", 73 as "Orange", and 86 as "Green". Thus far, The categorisation process primarily depended on the consumption of resources and the size of the industries. The pollution due to the discharge of emissions and effluents and its likely impact on health were not considered primary criteria. Then SPCBs/PCCs and industrial associations demanded industries categorisation more transparently. Accordingly, a "Working Group" comprising the members from CPCB, Maharashtra PCB, APPCB, WBPCB, TNPCB, PPCB and MPPCB was constituted to revisit the criteria of industries categorisation and suggest ways for making the system transparent and rational.

    The Working Group developed the criteria for the categorisation of industrial sectors depending on the Pollution Index (PI), which is a function of the effluents (water pollutants), emissions (air pollutants), hazardous wastes produced and resource consumption. The PI of any industrial sector is a number from 0 - 100. The increasing value of PI signifies the rising degree of pollution load from the industries. Based on the brainstorming sessions among SPCBs, CPCB, and MoEF&CC, the following criteria on the "Range of Pollution Index" for industrial categorisation were finalised.

    • Industrial sectors with PI score of 60 and more - Red category
    • Industrial sectors with PI scores between 41 and 59 - Orange category
    • Industrial sectors with PI scores between 21 and 40 - Green category
    • Industrial sectors with PI scores including  and upto 20 - White category

    The newly introduced White category represents non-polluting industrial sectors. This category contains 36 industrial sectors. These don't need to obtain the CTO from MPCB. An intimation to the concerned PCC/SPCB shall suffice.

    No Red category of industries is generally allowed in the ecologically sensitive/protected area.

    The purpose of categorisation is to guarantee that the industry is established in a way that is consistent with the environmental objectives. The new criteria prompt industrial sectors willing to adopt cleaner technologies, ultimately resulting in producing fewer pollutants.

  • 2. What is the scheme for MPCB Consent Certificate Renewal?

    Initially, the proposed scheme of auto-renewal of MPCB consent based on self-certification was introduced for the industries where consent was issued by CC/CAC committees of the Board.

    The key features of this scheme are as under:

    1. The auto-renewal of MPCB consent is applicable when there is no increase in overall production capacity and pollution load.

    2. Suppose there is a marginal increase (max.10%) in the capital investment because of clean technology, infrastructure development, pollution control systems and better production management, without an increase in pollution or production load. In that case, the industry must submit corresponding fees for CTE and the difference in CTO fees because the block year the capital investment is made on a pro-rata basis.

    3. If the capital investment is decreased, the industry must apply in the prescribed consent application form.

    4. The industry must submit a self-certification on compliance with earlier consent conditions. This self-certification must be submitted by the authorised official of the industry duly authorised by the Board of directors/owner.

    5. The auto-renewal can be availed for a maximum of 5 terms according to the existing practice of the Board, subject to payment of requisite fees.

    6. The industry must submit this format and the prescribed fees at MPCBE HQ or RO/SRO offices.

    7. If the application is submitted at RQ/SRO offices, RO/SRO must ensure that the same is forwarded to HQ within three days, along with info on fees paid, DD and DR details.

    8. The renewal is reflected on the MPCE website within seven days. If the renewal still needs to be reflected on the website within one week, e-mail cc-cacdesk@mpcb.gov.in and the application details, including the date and place of document submission.

    Note - The industries which have applied for plain renewal on or after 1st January 2012 can avail of this scheme.
