Karnataka State Pollution Control Board is entrusted with issuing KSPCB consent certificates to the state's projects/activities and industries. The Consent to Establish (CTE) is subject to the projects meeting the norms and adequacy of the suggestions for pollution control measures. If projects are included under EIA Notification, an EC will be issued by the Competent Authority. The Consent to Operate (CTO) is subject to compliance with norms stated in CTE and previous CTOs for renewal.

Karnataka State Pollution Control Board (KSPCB) - Overview

The Government of Karnataka formed the KSPCB on 21st September 1974 for the Prevention and Control (P&C) of Water Pollution. The board also issues KSPCB consent certificates. The Water (P&C of Pollution) Act, 1974 helps maintain or restore the water's wholesomeness. After the enactment of the Air (P & C of Pollution) Act, 1981, the enforcing responsibility was endowed to the board. As such, it was later renamed the KSPCB in 1985. The Air (P & C of Pollution) Act, 1981 is an enactment to offer for control, prevention and reduction of air pollution.

Apart from the above said Acts, the Karnataka SPCB also enforces the following rules and notifications stated under Environment (Protection) Act (EPA), 1986:

Procedure to obtain Karnataka SPCB consent certificates

Any person who is about to establish or take any steps to develop any process/industrial plant/any treatment and disposal system/any extension/addition which is expected to discharge trade effluent or sewage into any well/stream/sewer/on land must obtain Karnataka SPCB NOC

Similarly, any person who is expected to establish or operate any industrial plant in any air pollution control area (the entire Karnataka is declared as an air pollution control zone) is not allowed to discharge/cause/release the emission of any air pollutant over the standards framed by the KSPCB. These emissions must be with prior KSPCB consent.

Steps to obtain KSPCB CTE/CTO

  1. Generate online User ID & Password and receive SMS on mobile URL (https://kspcb.karnataka.gov.in/).
  2. Login to https://xgn.karnataka.gov.in/ with User ID & Password.
  3. Fill out the online application form for the KSPCB consent certificate.
  4. The application must be submitted online, along with all documents and technical details.
  5. The online application reaches the concerned Regional Office (RO).
  6. RO staff examines the file and, if found, completes, approves for making an e-sign by the proponent.
  7. If required, a request is sent through XGN query for submission of additional information. The project proponent gets an SMS alert for a query reply.
  8. After the proponent makes an e-sign, the RO, KSPCB, sends a request via XGN to pay the consent fee online (SMS/email).
  9. The project proponent submits the query reply online/e-sign the application forms.
  10. The project proponent pays the KSPCB consent fee online via the payment gateway (payment mode ATM cum Debit Card, Debit card, Credit Card, and Internet Banking facilities can be used).
  11. After the online consent fee payment, the file again reaches Regional Office (RO).
  12. Site inspection is done.
  13. The inspection procedure is defined in the XGN.
  14. For Green category units, the RO is authorised to decide the application for the grant of the KSPCB consent certificate.
  15. For Orange category units application, along with the inspection report, is sent to the concerned Zonal Office (ZO).
  16. The RO for the Red category units application and inspection report is sent to the concerned section of the Head office (HO) of KSPCB.
  17. The information on the decision of KSPCB regarding the Grant/refusal of Consent is communicated via SMS alert/email and through XGN.
  18. The copy of the digitally signed consent/authorisation & e-outwarded is made available in the applicant's login and on the KSPCB website (consent register).

Checklists for KSPCB consent certificate under various Acts & Rules

A. Consent for Establishment (CFE)

  1. Details of proposed pollution control measures (ETP/STP/APC) along with design details
  2. Rent agreement/Lease agreement in case the property is on rent/lease
  3. Allotment letter from KIADB/KSSIDC in case the industry is being set up in the Industrial area
  4. Documents w.r.t Special Economic Zone (SEZ) if applicable
  5. Site/location/layout Plan (for about 100m radius)
  6. SSI Certificate, if applicable
  7. Project report indicating location, the extent of land, water source, raw materials, products and by-products, water consumption details, wastewater generation & control measures with design parameters
  8. Manufacturing process write-up, manufacturing process flow chart
  9. Copy of partnership/proprietorship/company deed
  10. In case of mining, IBM approved mining plan must be enclosed
  11. Lease copy issued by “Department of Mines & Geology” in case of mining
  12. Forest Clearance (if applicable)
  13. Layout Plan indicating the location of manufacturing area, ETP/APC/STP and Solid/Hazardous waste storage & collection points
  14. Hazardous waste collection/generation/storage/disposal details
  15. Letter on assured water supply & disposal NOC from the local body for acceptance of effluent/sewage
  16. Khata extract/RTC
  17. Details of Pollution Control measures with design parameters
  18. Environmental Clearance (EC), if applicable
  19. Village Map in case of Layouts/Apartments/Commercial Projects

B. KSPCB Consent for Operation (1st CFO)

  1. Manufacturing process write-up, manufacturing process flow chart (in case of any change in the process)
  2. Compliance with earlier consent/CFE conditions (as applicable)
  3. Lease copy issued by “Department of Mines & Geology” in case of mining
  4. Effluent treatment proposal, if not submitted/if applicable
  5. Audited Balance sheet along with a schedule of fixed assets indicating Gross block of fixed assets
  6. Proprietor/Partnership/Company deed (if there is any change)
  7. In the case of mining IBM approved the mining plan
  8. Annual Report under HWM Rules (Form-4)
  9. EC/ECC, if applicable

C. KSPCB Consent for Operation (CFO) - Renewal

  1. Manufacturing process write-up, manufacturing process flow chart (in case of any deviation)
  2. Compliance with earlier consent/CFE conditions (as applicable)
  3. Lease copy issued by “Department of Mines & Geology” in case of mining
  4. Analysis report of effluent/stack emission (for KSPCB RCFO)
  5. Audited Balance sheet along with a schedule of fixed assets indicating Gross block of fixed assets
  6. In the case of mining IBM approved the mining plan
  7. Environmental Statement (Form-5)
  8. Annual Report under HWM Rules (Form-4)
