Bihar State Pollution Control Board was entrusted with the responsibility to issue BSPCB consent certificates under the Water and Air Acts. Granted in two phases, these consent certificates are mandatory for any industry or commercial activity that is about to start a business in the state.

Bihar State Pollution Control Board (BSPCB) - Overview

Bihar State Pollution Control Board was formed in 1974 under the norms of the Water (P&CP) Act 1974. Enactment of the said Act and constitution of this Board subsequently was ensuing Clause -I of Article 252 of the Constitution of India. The Water Act of 1974 was made applicable in the first instance to 12 States and Union Territories. Bihar was one of the said 12 states. The Board is entrusted with issuing BSPCB consent certificates (CTE/CTO).

Pre-establishing stage

BSPCB CONSENT TO ESTABLISH (NOC)

All industries setting their business in Bihar must obtain BSPCB NOC/CTE.

  4. Legitimate land document viz. Lease Agreement/Registered Paper/Kirayanama etc.
  5. Copy of Environment Clearance (EC), if needed.

BSPCB NOC Application and approval procedure

  1. Keep the scanned copy of all the relevant documents ready according to the abovementioned checklist.
  2. Register yourself with BSPCB using the URL http://bspcb.bihar.gov.in/ to generate a login ID and Password.
  3. Login to the site using the ID and Password.
  4. Apply for BSPCB Consent to Establish (SPCB NOC ) by selecting "CTE" from the options available.
  5. Fill in the application form, upload all the necessary documents and pay the requisite fee online using any bank's Debit/Credit Card/ Net Banking services.
  6. Submit the form online.
  7. The filled application form is scrutinised by the Assistant and Junior Environmental Engineer (JEE), followed by a site visit if required.
  8. In case there is any query, it is communicated to the applicant online, and a suitable timeline is allotted to answer the query.
  9. Afterwards, Junior Environmental Engineer (JEE) forwards the application with his recommendations to the Member Secretary.
  10. The Member Secretary then forwards the application and his recommendations to the Chairman for approval.
  11. After approval of the Chairman, BSPCB CTE/NOC gets issued by the Member Secretary.
  12. Further, it is sent to the applicant ID. The applicant must download the certificate from the website after logging in to his/her ID with BSPCB.

Pre-operation stage

BSPCB CONSENT TO OPERATE (EMISSION CONSENT)

All industries that have fulfilled the CTE conditions and are ready to start commercial operations must obtain BSPCB CTO.

  2. Compliance with Pollution Control Facilities.
  3. Compliance report of previous consent conditions (CTE/CTO).
  4. Test report, if any.
  5. Copy of EC, if needed.

BSPCB CTO application & approval procedure

  • Prepare the scanned copy of all necessary documents per the above-stated checklist.
  • Register yourself with BSPCB using the URL http://bspcb.bihar.gov.in/ to generate a login ID and Password.
  • Login to the site with the ID and Password.
  • Apply for BSPCB Consent to Operate by selecting the “CTO-Air” from the available alternatives.
  • Fill in the application form, upload all the relevant documents and pay the necessary fee online using any bank's Debit/Credit Card/ Net Banking services.
  • Submit the form online.
  • The filled application form for BSPCB NOC is scrutinised by the Assistant and Junior Environmental Engineer (JEE) after a site visit if needed.
  • If there is any query, it is communicated to the applicant online, and a suitable timeline is given to answer the query.
  • Subsequently, Junior Environmental Engineer (JEE) forwards the application with his recommendations to the Member Secretary.
  • The Member Secretary then forwards the application and his recommendations to the Chairman for approval.
  • After approval of the Chairman, BSPCB CTO (Emission Consent) gets issued by the Member Secretary.
  • Once the CTO (Emission Consent) gets issued, it is sent to the applicant ID. Emission Consent can be downloaded from the website after login by the applicant.
